To delete a user account(s), a deletion request is requested from the user. To ensure that the deletion process can be carried out smoothly, it must be ensured that the account to be deleted has no open shipments and/or journeys. For the time being, the account will only be deactivated when the deletion request is made. This ensures that the opposite party still has the opportunity to report incorrect behaviour (e.g. breaches of rules). The user is deactivated for 7 days. If no rule violation is reported by the opposing party within 7 days, the user is automatically deleted after the 7-day period has expired. However, if a rule violation is reported and checked by the TIWU team, the opposite party with whom the transaction was conducted will be informed. If the opposing party accepts the fact that the breach of rules has been committed and accepts it without further escalation (e.g. slight damage to the goods), the account can be deleted without further action. If the opposite party does not accept the offence, it has the right to request the personal data of the account to be deleted, such as full name, address and telephone number, before it is finally deleted. This ensures that the party (plaintiff) affected by the rule violation can get in contact with the rule violator (defendant) or use their data for legal action. If an account is deleted, it cannot be restored, as any (user-relevant) data is removed from the systems. To ensure that the opposite party in the system still has access to business-process relevant information on shipments/trips, certain data (shipment and trip relevant data, full name, user role) will continue to be displayed in the application. This data is retained for traceability reasons and is not deleted.
To delete your user
- A request must be submitted to remove the data.
Open app -> Settings -> Privacy and terms of use -> Delete user - The user is checked for open shipments/trips. (If he/she has open shipments/routes, he/she will be prompted to end or cancel them)
- Confirm that the user agrees to deactivate the account for the next 7 days
- The user is deleted/deactivated
- Deactivated: If the user has one or more activities in TIWU in the last 7 days
- Deleted: If the user has no activity in the last 7 days
- The application will be carefully reviewed by the TIWU team to determine whether a breach of the rules has occurred.
IF AN ABUSE/BREACH OF RULES IS REPORTED AND THE TIWU TEAM PERCEIVES THIS AS A GROSS VIOLATION OF THE RULES AND DOES NOT CONSIDER IT TO BE SO, THE USER REMAINS DEACTIVATED. ONLY AFTER THE DISAGREEMENT HAS BEEN CLARIFIED (BILATERALLY BETWEEN PARTIES CONDUCTING BUSINESS, THROUGH LEGAL CHANNELS, ETC.) WILL THE USER BE COMPLETELY DELETED.

Rule violation before deleting the user
If a rule violation is detected, the opposite party will be informed of the violation, if they have not already reported the violation themselves. TIWU has the right to hand over to the injured party all necessary personal data of the infringing party in case of suspicion of abuse and rule violations. This is intended to protect the injured party so that subsequent contact can be made.
TIWU has the right to disclose the following data of the user. The assumption of a rule violation is made solely by the TIWU team:
- Full name
- Home address
- Phone number
- Shipment/trip details about which the acceptance is a violation of the rules
Additional data may be issued in case of legal consequences:
- Picture of the identity card/passport (driver only)
- IP address with the corresponding timestamp
- Unique device name
Every user of TIWU already accepted these terms and conditions at his registration.
